Who we are

This site, thebiologycode.com, is operated by AGENCY WEALTH PARTNERS LLC, 9696 Bonita Beach Rd SE, Bonita Springs, FL 34135, United States ("we", "us"). We are the controller of the personal information described here. You can reach us at [email protected] or on +1 (239) 260-9386. The site is written for readers in the United States, and we operate it from there.

This policy covers this website only. It does not cover Amazon, the sellers we link to, or any other site you reach from ours (see "When you click out to Amazon or a seller" below).

What we collect

Newsletter details

If you subscribe to The Biology Code Brief, the form asks for one thing, your email address. When you submit it, our server records the email address, the date and time of sign-up, and the IP address the request came from. These are written to a private file on our server. We use them only to send you The Biology Code Brief and to manage your subscription, including honoring an unsubscribe request.

Messages you send us

If you email or call us, we keep what you tell us, including your contact details, for as long as we need to answer you and to keep a record of corrections and requests we have handled. Please do not include health information in a message.

Server and network records

Like any website, our servers and the network in front of them create technical records when a page is requested: your IP address, the date and time, the page requested, the page that referred you, your browser and device type, and security signals. These records are generated automatically by our hosting provider and by Cloudflare, which proxies this site to deliver it and to protect it from abuse. We use them to run the site, keep it secure and diagnose problems.

Your cookie choice

When you click Accept or Decline on the cookie banner, the site stores your choice in your browser's localStorage under the key tbc_consent so that it does not ask again on every page. That entry stays in your browser. It is not a cookie and is not sent to us. The choice is also passed on to Microsoft's advertising tag as a consent signal (see below).

Advertising measurement (Microsoft Advertising)

We use Microsoft Advertising's Universal Event Tracking (UET) tag to find out whether visits that started from a Microsoft or Bing ad lead to something on the site. By default the tag runs in a "denied" consent state on every page. Microsoft's documentation says that in that state UET does not read or write first-party cookies, does not write third-party cookies (it may read them for fraud and spam purposes only), and collects only anonymised data that is aggregated before it is modeled. Microsoft has also said that its two first-party cookies can still appear in that state holding only placeholder values with no identifier in them (see our Cookie Policy). Loading the tag does mean your browser contacts Microsoft's servers, which necessarily receive your IP address and the ordinary details of any web request.

If you click Accept, we tell the tag that consent is granted. It can then read and write its cookies and identifiers, and it reports to Microsoft data such as the page address, page title and referring page, your browser language and screen size, your IP address, a random visitor ID and session ID, and, if you arrived from a Microsoft ad, the ad-click identifier. The full list is in Microsoft's own UET documentation. Microsoft states that it retains this data for 390 days and does not resell it to third parties or share it with other advertisers. What Microsoft does with the data is governed by the Microsoft Privacy Statement. The names and lifetimes of the items involved are listed on our Cookie Policy page.

What we do not collect

We do not run user accounts, we do not take payments or card details, and we do not ask for or knowingly collect health information, precise location or government identifiers. Apart from the Microsoft Advertising tag described above, the pages do not load third-party advertising or analytics scripts, and the site's fonts are served from our own domain rather than a third-party font service.

How we use it, and why

We do not use your information to make decisions about you that have legal or similarly significant effects, and we do not build health profiles.

Who we share it with

• Service providers. Our hosting provider stores and serves the site, and Cloudflare proxies it for delivery and security. They process information on our behalf, or under their own terms as infrastructure providers, and only as needed to provide those services.
• Microsoft Advertising. Its tag loads on every page, so its servers receive your IP address and the ordinary details of the request. Cookies, visitor identifiers and the other measurement data described above are involved only if you click Accept.
• Authorities and advisers. We may disclose information if the law requires it, to protect our rights or the safety of others, or to our professional advisers under a duty of confidentiality.
• A successor. If the business or the site were sold or transferred, information could move to the new owner, who would have to honor this policy or tell you of any change.

We do not sell personal information for money, and we do not give newsletter addresses or messages to advertisers or sellers. Under California and some other state laws, allowing an advertising company to collect identifiers through a tag so that ads can be measured or targeted can count as "sharing" for cross-context behavioral advertising. To the extent that applies to the Microsoft tag, the identifiers and measurement data are collected only after you click Accept, and you can decline or withdraw at any time (see "Your choices").

When you click out to Amazon or a seller

Many entries link to Amazon or to a seller's own store. Those are separate websites run by other companies. When you follow one of those links your browser tells the destination which page you came from, and the link carries our affiliate identifier so that the sale can be credited to us. The destination can then set its own cookies and can connect your visit to any account you hold with it. We do not receive your account, order or payment details. Their privacy policies, not ours, apply from that point, so please read them before you buy.

How long we keep it

Security

We use reasonable technical and organizational measures to protect the information we hold, including serving the site over an encrypted connection and keeping the newsletter list in a private file on our server that we do not publish. No system is perfectly secure, however, and we cannot guarantee absolute security. If a breach affects your information, we will notify you and the authorities as the law requires.

Where information is processed

We operate from the United States, and our service providers may process information in the United States and in other countries where they operate. By subscribing or writing to us from elsewhere you understand that your information will be handled in the United States. Our providers describe the safeguards they use for international transfers in their own documentation.

Children

The Biology Code is written for adults and is not directed at children under 13. We do not knowingly collect personal information from anyone under 13. If you believe a child has given us information, contact us and we will delete it.

Your choices

• Accept or Decline. Use the buttons on the cookie banner. Advertising cookies and identifiers stay off unless you click Accept.
• Change your mind. Use the "Update cookie choice" button on the Cookie Policy page to clear your stored choice and see the banner again. Clearing cookies and site data for this site in your browser removes anything already stored.
• Global Privacy Control. If your browser or an extension sends a Global Privacy Control signal and you have not already made a choice on this site, we record it as Decline and do not show the banner. If you want to accept while the signal is on, switch it off in your browser first, then use "Update cookie choice" on the Cookie Policy page to clear the stored Decline. We do not act on the older "Do Not Track" header, because there is no agreed standard for it.
• Unsubscribe. Ask us to remove you from The Biology Code Brief at any time by emailing us, or by using the unsubscribe link in any email we send you.
• Microsoft's own controls. Microsoft explains how to opt out of personalised advertising in its Privacy Statement, and says it responds to Global Privacy Control signals in certain jurisdictions.

Your rights under US state privacy laws

California (the CCPA as amended by the CPRA) and a growing number of other states give residents privacy rights. Whether a particular law applies to us depends on our size and activities, but we offer the rights below to every visitor, wherever you live.

You can ask us to tell you what personal information we hold about you and how we use it; to give you a copy; to correct information that is wrong; to delete it (with some exceptions the law allows); to stop any sale or sharing of your personal information for cross-context behavioral advertising; and to limit the use of sensitive personal information (we do not collect any). You may also appeal a decision we make about your request. We will not deny you service, charge you a different price or give you a lower quality of service for using these rights. The California Attorney General and the California Privacy Protection Agency publish plain-language guides to these rights.

What we have collected, in California's categories

We collect this information from you and your browser. We do not sell personal information. Under California's definition, the only "sharing" is the Microsoft Advertising tag, and the identifiers and page data behind it are collected only after you click Accept. We do not disclose personal information to third parties for their own direct marketing (California Civil Code section 1798.83), and we do not sell "covered information" as defined in Nevada law.

Visitors in the European Economic Area and the United Kingdom

This site is written for readers in the United States. If you nonetheless use it from the EEA or the UK, the following applies. Our legal bases are set out in the table above: your consent (for the newsletter and for Microsoft Advertising measurement, which you can withdraw at any time without affecting what came before), and our legitimate interests in running, securing and responding through the site. You have the right to access your personal data, to have it corrected or erased, to restrict or object to its use, to receive it in a portable format, and to withdraw consent. You also have the right to complain to your data protection authority, for example the Information Commissioner's Office in the UK or your national authority listed by the European Data Protection Board.

How to make a request

Email [email protected] or call +1 (239) 260-9386, and tell us what you would like us to do. We will ask for enough information to confirm the request is genuinely from you, usually the email address you used to subscribe or write, and we will not ask for more than we need. An authorized agent may make a request for you if they give us your written permission and we can verify it.

We aim to respond within 45 days. If we need more time we may extend that once by up to a further 45 days and will tell you why. If we decline a request, we will explain the reason and tell you how to appeal, which you can do by replying to us. We aim to respond to an appeal within 45 days. If you are still not satisfied you can contact your state Attorney General.

Changes to this policy

We may update this policy from time to time. The date at the top of the page shows when it last changed. If we make a significant change to how we use personal information, we will say so on this page before the change takes effect.
